Responsibility for Advertising Content
Deadlines and Provision of Advertising Material
TWO TRIBES MEDIA (“The Publisher”)

All bookings based upon the relevant Rate Card will be subject to the Terms & Conditions specified therein, irrespective of any conditions or statements to the contrary in any purchase order, order form, or other contract submitted by any Advertiser, unless the Publisher specifically agrees otherwise in writing. Terms & Conditions are subject to change without notice.

The Publisher may require the advertiser to complete a Commercial Credit Account application prior to acceptance of advertising bookings from the client.
ADVERTISING RATES

Advertising rates and discounts are based on the understanding that contracts will be completed prior to the due date specified on the subsequent invoice.

Contracts not completed within this period may lose any discounts negotiated and are subject to an account keeping surcharge - unless the Publisher specifically agrees otherwise in writing.
CANCELLATION PROVISIONS

The last day for cancellation of an advertisement is the booking deadline as specified in the production schedule and communicated to advertisers by email. If an advertisement is cancelled after the booking deadline (last day for cancellation) the Advertiser agrees to pay the full charges specified on the Rate Card.

Upon cancellation prior to the cancellation date, for any reason, the Advertiser agrees to pay a handling charge to the publisher associated with the cancellation (for example artwork charges if artwork has already been produced prior to cancellation).

These charges will be made at the Publishers normal hourly service rates.
PAYMENT OF INVOICES

All advertising bookings submitted in accordance with the relevant Rate Card will be accepted by the Publisher subject to the agreement of the Advertiser to be liable for payment of all charges becoming due for the publishing of each advertisement.

Invoices will be issued upon making a booking for advertising or upon the booking deadline for ongoing bookings (whichever comes first).

Standard trading terms are strictly 28 days nett from the invoice date for invoiced amounts over $1K and 14 days nett from the invoice date for invoiced amounts under $1K unless the Advertiser has opened a Commercial Credit Account (30 days).
NON-PAYMENT OR LATE PAYMENT OF INVOICES

If the invoice becomes more than 30 days overdue and there has been no attempt made to pay the invoice the Publisher will refer the account to a debt collection service and additional charges may apply.

Should, during the period of the Agreement, the Advertiser’s business (a) cease to trade, (b) decide to cancel an ongoing advertising package OR (c) is sold, it is the sole responsibility of the Advertiser to either pay out the Agreement in total (this includes Ezidebit contracts), or alternatively if the business has been sold to ensure the new proprietor accepts the full responsibility of the ongoing cost to the expiry of the Agreement period.
MONTHLY PAYMENT PLANS

Monthly payment plans are available for Advertisers who have made a booking for a 6-11 month advertising package and who wish to spread the cost of the advertising contract.

Monthly payment plans accepted by the Publisher will be administered by Ezidebit and will require the advertiser to submit completed Ezidebit forms when requested.

Advertising will not commence until such forms have been submitted to the Publisher. Discounts do not apply when a monthly payment plan has been entered into except with the express written agreement of the Publisher.
RESPONSIBILITY FOR ADVERTISING CONTENT

All advertising bookings submitted to the Publisher are accepted only upon the express condition that the Advertiser, upon lodging material with the Publisher for publication, or authorising or approving of the publication of any material, indemnify the Publisher, its servants and agents against all liability claims or proceedings whatsoever arising from the publication and without limiting the generality of the foregoing so indemnify each of them in relation to defamation, slander or title, breach of copyright, infringement of trademarks or names or publication titles, unfair competition or trade practices, royalties or violation of rights of privacy and warrant that the material complies with all relevant laws and regulations and that its publication will not give rise to any rights against liabilities to the Publisher, its servants or agents.
DEADLINES & PROVISION OF MATERIAL

Two Tribes Media utilises it’s own in-house art department to produce artwork for advertisers in intouch magazine. The charge for creating artwork is included in the cost of the advertising at time of booking.

The provision of material (copy and images) for the production of artwork is the responsibility of the advertiser.

If the advertisement is booked and material is not provided on or before the due date to meet the production schedule of the publisher an additional artwork charge may be applicable.
